1. Acceptance of Terms

By accessing or using JobSnap ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, do not access or use the Service. The Service is operated by NexCircuit LLC, a Wyoming limited liability company ("Company," "we," "us," or "our").

2. Description of Service

JobSnap is a software-as-a-service (SaaS) platform for electrical contractors and tradespeople. Features include: creating quotes and estimates, managing work orders, scheduling jobs, generating professional PDF reports, AI-powered electrical fault diagnostics based on the National Electrical Code (NEC), client communication, and payment processing through integrated third-party services. The Service is accessed via web browser on desktop and mobile devices.

3. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

JobSnap offers a free plan with limited usage and paid subscription plans with expanded features. Current plan details and pricing are published on our Pricing page and are incorporated into these Terms by reference.

  • Free plan includes up to 5 quotes per month and 3 AI diagnostic questions per day.
  • Paid subscriptions are billed monthly in advance via Stripe and auto-renew until cancelled.
  • You may cancel at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • All fees are in US Dollars and are non-refundable except as required by applicable law.

5. Payment Processing (Stripe)

Payment processing for client invoices is handled by Stripe, Inc., a PCI DSS Level 1 certified payment processor. By using the payment features, you agree to Stripe's Connected Account Agreement and Stripe's Terms of Service.

  • JobSnap does not store your clients' full credit card numbers or sensitive payment credentials.
  • Stripe transaction fees apply to payments processed through the platform. See Stripe's pricing for details.
  • You are responsible for all chargebacks, payment disputes, and refunds initiated by your clients.
  • We reserve the right to withhold payouts or suspend payment features if we detect fraudulent activity.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local laws or regulations.
  • Transmit viruses, malware, ransomware, or any other harmful or malicious code.
  • Attempt to gain unauthorized access to other users' accounts, data, or our systems.
  • Use the Service to harass, abuse, or harm other persons.
  • Use automated means (bots, scrapers) without our prior written consent.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use the AI features to generate content that is illegal, fraudulent, or harmful.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy, with or without notice, at our sole discretion.

7. AI Features Disclaimer

JobSnap includes AI-powered diagnostic features that provide electrical fault analysis and NEC code references. These features are powered by third-party AI models (including DeepSeek).

  • AI output is informational only. It does not constitute professional engineering advice, legal advice, or a substitute for a licensed electrician's judgment.
  • You must independently verify any AI-generated information before relying on it for actual electrical work.
  • Do not include personally identifiable information of your clients in AI queries. AI prompts are transmitted to third-party model servers for processing.
  • We make no warranties regarding the accuracy, completeness, or reliability of AI-generated content.

8. Your Data and Content

You retain all ownership rights to the data, content, and materials you upload or create within the Service ("Your Content"). By using the Service, you grant us a limited, worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, and display Your Content solely for the purpose of providing and improving the Service to you.

You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not violate any third-party rights or applicable laws.

9. Intellectual Property

The Service, including its original content, features, functionality, design, trademarks, and underlying code, is owned by NexCircuit LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use the Service as set forth herein.

10. Third-Party Services

The Service integrates with third-party services including but not limited to:

  • Stripe, Inc. — payment processing
  • DeepSeek / AI model providers — AI diagnostic features
  • Resend — email delivery

We do not control these third-party services and are not responsible for their content, privacy practices, or availability. Your use of third-party services is subject to their respective terms and policies.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NEXCIRCUIT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless NexCircuit LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right or privacy right; or (d) your violation of applicable laws or regulations.

13. DMCA Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe that any material available through the Service infringes your copyright, please send a written notification to:

Your notice must include: (a) a description of the copyrighted work; (b) the URL or location of the infringing material; (c) your contact information; (d) a statement of good faith belief; and (e) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.

14. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court.

  • Class Action Waiver: You and NexCircuit LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
  • Small Claims Exception:Either party may bring an individual action in small claims court instead of arbitration if the claim falls within the court's jurisdiction.
  • Opt-Out: You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to legal@circuitjob.com.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. For any disputes not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Wyoming.

16. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your data in accordance with our Privacy Policy; (c) you will remain liable for all amounts due up to and including the date of termination.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes via email to the address associated with your account, and/or by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

18. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and NexCircuit LLC regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
  • Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control.
